What is Nursing Home Abuse?

Elder abuse can take many forms in a nursing home, most of which occur behind closed doors. The World Health Organization defines elder abuse as “a single, or repeated act, or lack of appropriate actions, occurring within any relationship where there is an expectation of trust, which causes harm or distress to an older person.”

In a nursing home setting, this typically occurs when a resident is abused or neglected by employees of that facility. Unfortunately, this neglect or elder abuse can result in significant injuries including death in extreme cases.

Sadly, abuse and neglect are often not just the actions of a ‘bad apple’ or criminal employee. Rather, they are the result of a systemic problem. The nursing home industry has become a multi-billion dollar business composed of major corporations where efficiency and profitability are more important than administering proper care. For this reason, both federal and state governments have introduced legislation to protect residents from abuse.

Why File a Lawsuit?

In cases involving nursing home abuse and neglect, the role that a lawsuit plays is vital. First, a lawsuit can help you recover the financial compensation you need to move your loved one to a better facility, treat their injuries, and move on from the abuse – if possible. However, in cases of systemic, institutional issues, a lawsuit can force companies to change how they treat patients, staff facilities, and hire employees. A successful lawsuit can, in effect, prevent the same abuse from happening to another resident.

Frequently Asked Questions

What Are the Signs of Nursing Home Abuse or Neglect?

If your loved one is in a nursing home, common risk factors that may signal that abuse or neglect is occurring include, isolation, having few social interactions throughout one’s day, poor physical health, decreased mental health or dementia, and substance abuse.

In some homes, signs of abuse show in small ways that can lead to much larger issues – for example, understaffing leads to overworked staff members who make dangerous mistakes. At the most extreme, nursing homes that skimp in vital areas can expose their residents to abusive or criminal staffers; uncontrolled infections; and neglect of some of the basics of patient care.

What Should I Do If I Suspect Negligence or Abuse?

If you suspect that your loved one is being sexually abused while at a nursing home, contact the authorities to ensure their safety and to have their claim documented so that the situation can be investigated immediately.  If you are unsure who to contact, start by:

  • Calling a nursing home abuse hotline
  • Connecting with a long-term care ombudsman
  • Contacting your state’s adult protective services (APS)

After you have reported the potential abuse or neglect, contact an attorney.  The facility or staff members may take steps to cover up the abuse, so having a lawyer to gather evidence and help protect your loved one right away is essential.

We understand that no amount of compensation will ever reverse the harm caused to you or your loved ones, but a Philadelphia nursing home abuse lawyer at our firm will work to hold the liable party responsible for all of the injuries sustained from their neglect or reckless act.
